This Privacy Policy describes how Shadow Concepts LLC, DBA Under30Experiences ("Under30Experiences", "we", "us" or "our") collects and uses your information through the Under30Experiences.com website (the "Site") and handles the information you provide through your use of the Site.

The term "you" refers to the customer visiting the Site and/or booking a reservation through us on the Site or through our Service Providers. Specifically, the protections for your information detailed in this Privacy Policy apply to information relating to you that can be directly or indirectly associated with you using an identifier.

By using our Site or purchasing any product or service online from Under30Experiences (collectively, the "Services"), you accept the terms of our Privacy Policy. If you do not accept the terms of this Privacy Policy, do not use the Services.

Why We Process Your Personal Information

Under30Experiences seeks to provide fun, stress-free, and accessible travel experiences. Accomplishing that mission requires the concerted efforts of many interconnected parties.

Under30Experiences is the trip organizer that designs, sells, and operates small-group travel experiences. We work with Local Partners and Service Providers, including transportation operators, lodging providers, activity vendors, and other contractors, to deliver these experiences.

When you book a reservation through us or through our Service Providers, Under30Experiences requires access to your information to facilitate travel arrangements and process payment. We also use your information to provide customer support, provide materials and promotions we believe will be of interest to you, and improve the experiences we offer.

Information We Process

We collect, use, transfer, and store information you provide us as described below.

1. Information You Provide to Us
We collect and store information you provide to us. We may ask you to provide information including, but not limited to, your name, birth date, gender, phone number, email and physical address, and payment information (when necessary). You can choose not to provide us with certain personal information, but this may limit our ability to provide some services or features we offer. To use our Services or create an account with Under30Experiences, you must, at a minimum, provide and maintain a valid email address.

Payment information is processed by third-party payment processors such as Stripe. Under30Experiences does not store full credit card numbers. We may receive limited payment details such as transaction ID, card type, last four digits, billing address, and payment status.

If you sign up for a trip, we collect additional information to ensure your safety and to help you travel the world. This trip-specific information is collected only if you sign up for a trip and is used for trip logistics, traveler safety, emergency response, Service Provider coordination, legal compliance, insurance, fraud prevention, and related operational purposes. This information includes: full name, email address, passport information, birthdate, address, dietary and medical information disclosed for trip safety, and emergency contact information. We do not use passport information, emergency contact information, or medical information you disclose for unrelated marketing.

Sensitive Personal Information

Depending on your booking and trip, we may collect sensitive personal information such as passport or government identification details, birthdate, health or medical information you choose to disclose, dietary restrictions that may reveal health or religious information, emergency contact information, and information related to trip safety incidents. We use this information only for trip logistics, traveler safety, emergency response, legal compliance, insurance, fraud prevention, and related operational purposes. We do not use sensitive personal information to infer characteristics about you or for unrelated marketing, and we do not sell sensitive personal information.

2. Other Information We Collect From You
We may also automatically collect and store various types of usage information whenever you interact with our Site. We may use a variety of methods to collect this information, including cookies, pixel tags, log files, web beacons or other tools ("Collection Tools"). Usage information we may collect includes, but is not limited to, information on our server logs from your browser including your IP address, cookie information, device hardware information, browser type and language, system type, whether you have enabling software to access certain features, referring website URLs, information about your purchases, and other information about your interactions with us. We use Collection Tools to enhance your experience and make it more efficient, such as to allow you to stay logged in, remember your preferences, confirm delivery of email communications, and other features. If you prevent these Collection Tools, some features of the Site may not function properly.

Our Site uses a cookie banner that allows you to manage your cookie preferences. You may adjust your preferences at any time using the cookie banner or your browser settings. Under30Experiences recognizes and honors browser-based privacy signals, including Global Privacy Control (GPC), where these signals indicate your preference to opt out of the sale or sharing of personal information.

3. Children's Privacy
We do not knowingly collect or solicit personal information from children who are under age 16. If you are under 16, do not provide personal information through the Site. If we learn we have collected or received personal data from a child under 16 without verification of parental consent, we will delete that information. Note that separate age requirements apply to booking, travel, site use, and SMS messaging as described in our Terms of Service and Mobile Terms of Service: minors aged 16 or 17 may participate in the SMS messaging program with the permission of a parent or legal guardian where required, but booking and travel are limited to participants aged 21 and over for publicly offered trips. If you believe we might have any information from or about a child under 16, please contact us at info@under30experiences.com. For custom, institutional, or educational programs involving minors, additional notices, consents, or institutional agreements may apply.

4. Purposes for Processing
We use your Personal Information to provide the Site and Services, which includes without limitation the following purposes:

1. To provide a user account and enable access to our services, features and other activities;
2. To enhance, customize and personalize your experiences and communications;
3. To operate, provide, improve and maintain our products and services, including analyzing user behavior using Collection Tools and to request user feedback relating to the Services;
4. To communicate with you about your purchases, account information and other administrative or customer service issues;
5. To enable sharing and publishing of information upon your request as described in the "Information You Share" section below;
6. To administer promotions, provide features and display relevant marketing to you;
7. To contact you as described in the "Communication & Notifications" section below;
8. To arrange travel and accommodations on your behalf, including the transfer of your information to third-party Service Providers to the extent such transfers are necessary;
9. To process credit card payments and billings;
10. To provide shipping for any products you order;
11. To maintain emergency contact information for you in the event of an emergency;
12. To enforce or apply our Terms of Service and other agreements, or protect the rights, property or safety of Under30Experiences, our employees, affiliates, users or others, and defend ourselves against third-party claims; and
13. To detect and prevent fraud, including monitoring for fraudulent payments.

Communication & Notifications

We may use email, phone (including SMS marketing where you have opted in), WhatsApp, or other contact methods to communicate with you. WhatsApp is used for group trip communication, customer service inquiries, and similar operational and promotional purposes. Cancellation and transfer requests for bookings must be submitted by email as described in our Booking & Cancellation Policy; requests submitted via WhatsApp, social media, chat boxes, or other channels are not valid for cancellation or transfer purposes.

We may also use these channels to:

1. Notify you of special offers, newsletters, and product alerts or features in which we believe you may be interested;
2. Request information regarding your account or payment;
3. Disseminate passwords, validate requests, and provide customer support; and
4. Provide you with the information that you request.

To unsubscribe from certain communications, please change your account communications settings or follow the instructions in the email or other communication you receive. There are some essential, administrative communications for which you cannot opt out. Regardless of the settings you select, we may still send you service-related communications. Opt-outs from automated email and SMS marketing are generally processed promptly, though brief delays may occur for messages already queued for delivery.

Information We Share

We may share your information for the purposes described below.

1. Service Providers and Local Partners
We may share your information with our Service Providers, Local Partners, or contractors to conduct business on our behalf. For example, they may handle maintaining servers, processing credit card payments and billings, providing shipping, providing adventure travel activities and related products and services, lodging, ground transportation, and other services necessary to deliver your trip.

2. Business Transfers
If Under30Experiences goes through a business transition (such as a reorganization, corporate restructuring, merger, acquisition or sale of a portion of our assets), user information, including your personal information, would be one of the assets that is transferred or acquired. You acknowledge that such transfers may occur, and that any party who acquires our assets or succeeds to our business may continue to use your information as set forth in this Privacy Policy.

3. By Law or to Protect Rights
We may disclose information when we believe that disclosure is necessary to comply with the law, to enforce or apply our Terms of Service and other agreements, or to protect the rights, property or safety of Under30Experiences, our employees, affiliates, users or others, and defend ourselves against third-party claims. This may include exchanging information with other companies and organizations for fraud protection and credit risk reduction. We may also disclose information upon governmental request or in response to a court order.

We may also share information with emergency contacts, medical providers, insurers, Service Providers, Local Partners, law enforcement, embassies or consulates, or other authorities where reasonably necessary for traveler safety, emergency response, incident management, legal compliance, insurance, or protection of rights.

4. With Your Consent
We may share information when you provide us with your consent to do so. This may occur either when you affirmatively consent to a request or you consent as provided in this policy. For instance, when you request goods, information, or services from our affiliates, partners, service providers, travel operators, or other third parties through us, or when you post information to our Site, you provide your consent for us to share that information with others. Please note that whenever you post public information on or through our Site you are giving us your consent to share that information with third parties.

5. What We Don’t Share
We will not share your personal information with any third party who is not affiliated with Under30Experiences except as described in this Privacy Policy. We will not share your personal information to be used for the purposes of sending you unsolicited commercial offers from third parties. We do not sell your personal information for monetary consideration, and we do not sell sensitive personal data under any circumstances. Note that under some state privacy laws, including California, certain uses of advertising or analytics cookies may be considered "sharing" of personal information; see the "Sale or Sharing of Personal Information" section below for opt-out options.

6. SMS/Text Messaging Data
If you opt in to receive SMS or text messages from Under30Experiences, we collect and maintain your mobile number, opt-in status, consent records, message interaction data, and related messaging information. We do not sell, rent, or share SMS opt-in data or consent records with third parties for their independent marketing or promotional purposes. SMS data may be shared with Service Providers who help us deliver messaging services, subject to contractual restrictions and only as necessary to provide those services.

Information You Share

We may offer features that allow you to share your activity from Under30Experiences on social media platforms such as Facebook, Instagram, TikTok, or others. Your settings on those platforms will control how your information is shared within those platforms. To adjust what information is shared on those platforms, adjust your settings within those platforms. Please read the privacy policies of those platforms, because Under30Experiences activity and content published on those platforms will no longer be governed by our Privacy Policy. You are responsible for the information you choose to share in this way.

How We Protect Information

We use a variety of security measures to protect your information, including encryption in transit (such as HTTPS/TLS), encrypted storage where appropriate, and authentication tools. Personal information shared with Trip Leaders and Local Partners on the ground (such as traveler manifests, passport information, and emergency contact details) is treated as confidential, used only for trip operations and emergency response, and retained only as long as reasonably necessary for trip delivery, recordkeeping, insurance, and compliance purposes. Internet transactions can be risky. You acknowledge that you provide your personal information at your own risk. Information could be intercepted before it reaches us, and there is a risk that our security measures may not be sufficient to prevent every conceivable threat to your information. We are not responsible for the unlawful actions of others or the illegal circumvention of any privacy settings or security measures. If we discover a security breach that compromises your personal information, we will inform you in accordance with applicable law.

Protect Your Information

You are responsible for maintaining the security of your account and password, restricting access to your computer or device, and you agree to accept responsibility for all activities that occur under your account or password. Please keep your password secure. Do not share your password with anyone else.

Access to Information

To modify or delete your personal information, please update your account profile or contact us at info@under30experiences.com. Note that your old personal information may reside in our backup files and archives until it is deleted through our data storage procedures.

Third Party Sites

We are not responsible for the content of any pages, websites, applications or other services linked to or from our Site. Links appearing on our Site are for convenience only and are not an endorsement by us or our affiliates or their partners of the referenced content, product, service, or supplier. Your linking to or from any off-site pages or other websites is at your own risk. You should carefully review the terms and conditions and privacy policies of all other pages, websites, applications, and other services that you visit and/or use.

Retention

We will retain your personal information for the period necessary to provide you with access to the Site, the Services, and to carry out the Purposes described above, unless a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other legitimate and lawful business purposes.

We retain different categories of information for different periods depending on the purpose. Booking, transaction, tax, and accounting records are retained for the period necessary for legal and financial recordkeeping. Trip safety, incident, insurance, and emergency records are retained for the period necessary to address insurance, legal, risk management, and compliance needs. Marketing data is retained until you unsubscribe or we no longer need it for lawful marketing purposes. Cookie and analytics data is retained according to our cookie settings and vendor configurations. Trip-specific information collected for safety and logistics purposes (such as passport details and emergency contacts) is generally retained for the duration of the trip and a reasonable period thereafter for recordkeeping, insurance, and compliance purposes.

GDPR Compliance

The additional rights and disclosures set forth in this section apply if you are a resident of the European Economic Area, Switzerland or the United Kingdom.

2. Data Processors 
We utilize the services of various Service Providers to provide the Site and Services. Our processors may change from time to time, but have all entered into agreements that restrict their use and processing of your personal data. If you would like information regarding the categories of Service Providers and Local Partners who have received your information, please contact us at info@under30experiences.com.

3. Purposes of Processing & Lawful Basis
We process your personal data for the purposes described in the section labeled "Purposes for Processing" above. We process personal data under different lawful bases depending on the context, including: performance of a contract to process bookings and deliver trips; legitimate interests to operate and improve our Site and Services, prevent fraud, maintain security, and enforce our rights; consent for certain marketing, cookies, SMS messaging, or optional disclosures; legal obligations where applicable; and vital interests where necessary for emergency response. If we request your consent with respect to any specific processing of your personal data, then we are relying upon such consent as the lawful basis for such processing.

4. Data Privacy Rights

5. Complaints; Supervisory Authority

We will cooperate with the appropriate regulatory authorities to resolve any complaints regarding your personal data. You also have the right to submit a complaint to a data protection authority about our collection and use of your personal data. Transfers of Personal Data

Under30Experiences is headquartered in Texas, United States. We engage international contractors and Local Partners in the destinations where we operate trips. When you purchase an international travel experience, pursuant to your agreement with us, we will transfer the information necessary for Under30Experiences to perform under its agreement with you and any information necessary for the conclusion of a contract concluded on your behalf. In connection with this process, it may be necessary for us to transfer your personal data to the jurisdiction of the party with whom you have booked any travel experiences. Such transfers will be limited to the extent necessary to facilitate your travel. Where required by applicable law, we rely on appropriate transfer mechanisms or safeguards, such as standard contractual clauses, adequacy decisions, derogations necessary for performance of a contract, or other lawful transfer mechanisms. We never sell your information to third parties.

How to Exercise Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, obtain a copy of, or opt out of certain processing of your personal information. To submit a privacy request, contact us at info@under30experiences.com. We may need to verify your identity before responding. You may also designate an authorized agent to submit requests on your behalf where applicable law permits; we may require proof that the agent is authorized to act on your behalf and may require you to verify your identity directly with us. We will respond within the timeframe required by applicable law.Please note that we may deny or delay deletion requests, or retain limited information, for data we are required or permitted to retain by law, including for ongoing tax audits, financial recordkeeping, insurance and liability requirements, fraud prevention, or to enforce our agreements.

5. Geolocation data (general location based on IP address; we do not collect precise geolocation)
6. Sensory data (photographs and recordings taken during trips, subject to the media release language in our Travel Waiver, which each traveler signs before participation)
7. Inferences drawn from the above (preferences, interests)

Sources of Personal Information
We collect personal information from: (i) directly from you when you create an account, book a trip, contact us, or interact with the Site; (ii) automatically through Collection Tools when you interact with the Site; (iii) from Service Providers and Local Partners involved in operating your trip; and (iv) from publicly available sources where applicable.

Business and Commercial Purposes for Collection
We use personal information for the purposes described in the "Purposes for Processing" section above, including operating our Services, processing bookings and payments, communicating with you, providing trip logistics and safety support, marketing, fraud prevention, and complying with legal obligations.

Categories of Third Parties
We may share personal information with the following categories of third parties: Service Providers and Local Partners (lodging providers, transportation operators, activity vendors); payment processors; technology service providers (hosting, analytics, communications); marketing platforms (where you have consented to receive marketing); and government authorities or law enforcement where required by law.
